Product Authenticity, Quality Assurance & Anti-Counterfeit Policy

This policy explains how Get Lubricants approaches supplier verification, quality assurance, product traceability, and counterfeit-risk management across its product supply chain.

By purchasing through the platform, customers acknowledge and agree to the authenticity and quality controls described below.

1. Introduction

Get Lubricants is a brand owned, operated, managed, and controlled by NexG Petrolube Private Limited ("Company"), a company incorporated under the provisions of the Companies Act, 2013.

The Company recognizes that product authenticity, quality assurance, product traceability, supply chain integrity, and customer confidence are fundamental to the safe and effective use of lubricants, greases, coolants, industrial oils, specialty fluids, maintenance products, automotive chemicals, and associated products.

This Product Authenticity, Quality Assurance & Anti-Counterfeit Policy ("Policy") establishes the standards, procedures, responsibilities, limitations, and safeguards adopted by Get Lubricants in relation to the sourcing, procurement, storage, distribution, sale, verification, quality monitoring, and authenticity assessment of products offered through the platform.

This Policy shall be read together with the Terms of Use, Privacy Policy, Shipping Policy, Returns & Refund Policy, Technical Advisory Disclaimer, Marketplace Policy, Payment Policy, and all other policies published by the Company.

By purchasing products through Get Lubricants, customers acknowledge and agree to the provisions contained in this Policy.

2. Commitment to Product Authenticity

Get Lubricants is committed to supplying products that are sourced through legitimate and commercially recognized supply chains.

The Company endeavors to procure products from:

  • Original Equipment Manufacturers (OEMs).
  • Authorized distributors.
  • Authorized stockists.
  • Approved importers.
  • Certified channel partners.
  • Authorized resellers.
  • Manufacturer-approved supply chains.
  • Verified marketplace sellers.

The Company maintains reasonable commercial procedures intended to minimize the risk of counterfeit, adulterated, tampered, expired, diverted, or unauthorized products entering its supply chain.

However, due to the complexity of global supply chains, the Company cannot guarantee absolute elimination of all risks associated with counterfeit activities, unlawful diversion, unauthorized resale, packaging duplication, or third-party misconduct.

3. Quality Assurance Framework

The Company maintains quality assurance processes designed to verify products before listing, storage, dispatch, and delivery.

Such procedures may include:

  • Supplier verification.
  • Documentation review.
  • Packaging inspections.
  • Batch verification.
  • Product traceability assessments.
  • Inventory controls.
  • Random quality audits.
  • Supply chain reviews.
  • Product condition inspections.

The implementation of such procedures shall not be interpreted as a guarantee of product performance, suitability, or merchantability for any specific application.

4. Authorized Supply Chain Policy

The Company endeavors to transact only with suppliers who satisfy internal verification requirements.

Verification procedures may include:

  • Business registration verification.
  • GST verification.
  • Trade license verification.
  • Distributor authorization checks.
  • Manufacturer confirmations.
  • Import documentation reviews.
  • Product sourcing reviews.
  • Financial due diligence.

The Company reserves the right to suspend, terminate, reject, or discontinue supplier relationships at its sole discretion.

5. Product Traceability

Where reasonably practicable, the Company may maintain records relating to:

  • Batch numbers.
  • Manufacturing dates.
  • Supplier information.
  • Purchase documentation.
  • Inventory movement.
  • Dispatch records.

Traceability records are maintained for operational and quality control purposes.

The Company reserves the right to determine the extent and duration of such record retention in accordance with business requirements and applicable laws.

6. Product Packaging and Appearance

Manufacturers may periodically modify:

  • Packaging designs.
  • Labels.
  • Branding.
  • Product codes.
  • Security features.
  • Container designs.
  • Color schemes.
  • Product descriptions.

Accordingly, minor variations between website images and delivered products shall not automatically indicate counterfeit status or product defects.

Customers are encouraged to evaluate products using official manufacturer references where available.

7. Product Images Disclaimer

Product images displayed on the platform are intended for illustrative purposes only.

Actual products may differ due to:

  • Packaging updates.
  • Manufacturer revisions.
  • Label changes.
  • Product redesigns.
  • Batch variations.

The Company shall not be liable for claims arising solely from differences between displayed images and actual packaging where the delivered product remains genuine and materially consistent with the product description.

8. Manufacturing Date, Shelf Life and Storage

The Company endeavors to maintain inventory in accordance with reasonable storage practices.

However, product suitability may be affected by:

  • Storage conditions.
  • Environmental exposure.
  • Temperature variations.
  • Customer-side handling.
  • Shelf-life limitations.

Customers remain responsible for inspecting products upon delivery and ensuring proper storage thereafter.

The Company shall not be liable for degradation occurring after delivery.

9. Product Quality Limitations

The Company acts as a seller, distributor, marketplace facilitator, procurement platform, or intermediary depending upon the nature of the transaction.

The Company does not manufacture most products offered through the platform.

Accordingly, the Company does not independently warrant:

  • Product composition.
  • Manufacturing quality.
  • Product performance.
  • Technical specifications.
  • Product suitability.
  • Regulatory approvals.

Such matters remain the responsibility of the respective manufacturer unless expressly stated otherwise.

10. Counterfeit Prevention Measures

To minimize counterfeit risks, the Company may implement:

  • Supplier screening.
  • Batch verification.
  • Packaging inspections.
  • Procurement controls.
  • Inventory audits.
  • Manufacturer confirmations.
  • Product authentication reviews.

These measures are undertaken on a commercially reasonable basis and shall not constitute an absolute guarantee against all counterfeit activities.

11. Customer Authenticity Verification

Customers who believe a product may not be genuine must immediately notify the Company.

The customer must retain:

  • Original packaging.
  • Product containers.
  • Batch numbers.
  • Security labels.
  • Invoices.
  • Delivery documentation.

Failure to preserve evidence may impair the Company's ability to investigate claims.

12. Counterfeit Investigation Procedure

Upon receipt of a counterfeit allegation, the Company may undertake one or more of the following actions:

  • Request supporting documentation.
  • Obtain photographs.
  • Review procurement records.
  • Consult suppliers.
  • Consult manufacturers.
  • Conduct technical inspections.
  • Engage laboratories.
  • Obtain independent assessments.

The Company reserves the right to determine the scope and methodology of investigations.

No admission of liability shall arise solely because an investigation is initiated.

13. False or Fraudulent Claims

The Company takes fraudulent authenticity claims seriously.

Where the Company reasonably believes that a claim is false, misleading, fabricated, malicious, intended to obtain unjustified refunds, or intended to damage reputation, the Company reserves the right to reject claims, suspend accounts, terminate accounts, refuse future transactions, or pursue legal remedies.

14. Product Performance Disclaimer

Product authenticity does not guarantee product performance.

Even genuine products may perform differently depending upon operating conditions, maintenance practices, storage conditions, product compatibility, equipment condition, and user handling practices.

The Company shall not be liable for performance expectations that are inconsistent with manufacturer specifications.

15. Wrong Product Selection

The Company shall not be responsible where a customer purchases a genuine product that is unsuitable for the intended application.

Customers remain solely responsible for verifying:

  • OEM requirements.
  • Viscosity grades.
  • Product approvals.
  • Compatibility requirements.
  • Performance specifications.

Claims relating to incorrect product selection shall not constitute authenticity claims.

16. Laboratory Testing Disclaimer

The Company may, at its discretion, facilitate laboratory testing or independent technical evaluations.

Such testing shall not create any obligation upon the Company to accept claims, issue refunds, provide compensation, or admit liability.

Laboratory findings shall be evaluated together with all relevant facts and circumstances.

17. Product Recalls

Where manufacturers announce product recalls, safety notices, quality alerts, or corrective actions, the Company may communicate relevant information to affected customers where reasonably practicable.

The Company reserves the right to remove affected products from sale, suspend listings, or implement corrective measures without prior notice.

18. Marketplace Products

Where products are supplied by third-party sellers through the platform, authenticity obligations may also rest with such sellers.

The Company reserves the right to require sellers to demonstrate product authenticity, provide sourcing records, provide distributor authorizations, and cooperate in investigations.

The Company may suspend sellers pending investigation.

19. Industrial and Bulk Orders

Industrial lubricant purchases, bulk deliveries, tanker supplies, project supplies, institutional procurements, and OEM supply arrangements may be subject to separate quality verification procedures.

Customers shall inspect products immediately upon receipt.

Acceptance of bulk deliveries may constitute acknowledgment that products were received in satisfactory condition.

20. Limitation of Liability

To the maximum extent permitted by law, Get Lubricants, NexG Petrolube Private Limited, its directors, officers, employees, affiliates, suppliers, marketplace sellers, logistics partners, consultants, and service providers shall not be liable for indirect, incidental, consequential, punitive, special, or economic damages arising from authenticity disputes, quality disputes, product investigations, product recalls, performance concerns, or related matters.

The aggregate liability of the Company shall not exceed the actual purchase value of the product giving rise to the claim.

21. Customer Indemnity

Customers agree to indemnify and hold harmless Get Lubricants, NexG Petrolube Private Limited, its directors, officers, employees, affiliates, suppliers, marketplace sellers, and service providers from claims arising out of:

  • Product misuse.
  • Improper storage.
  • Product alteration.
  • Product contamination.
  • Unauthorized resale.
  • False authenticity allegations.
  • Regulatory violations.

22. Consumer Protection Compliance

Nothing contained in this Policy shall limit rights that cannot legally be excluded under applicable consumer protection laws.

The Company shall endeavor to investigate genuine complaints fairly, transparently, and in accordance with applicable legal requirements.

23. Dispute Resolution

Any dispute arising out of or relating to product authenticity, product quality, anti-counterfeit investigations, supplier verification, product recalls, laboratory testing, or related matters shall be governed by the laws of India.

Such disputes shall be resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996.

The seat and venue of arbitration shall be Kolkata, West Bengal, India.

Subject to the arbitration provisions, the courts situated in Kolkata, West Bengal shall have exclusive jurisdiction.

24. Policy Amendments

The Company reserves the right to revise, modify, update, replace, suspend, or amend this Policy at any time.

The latest version published on the platform shall govern future transactions unless otherwise required by applicable law.
