Terms of Use and Conditions

Get Lubricants is a brand owned, operated, managed, and controlled by NexG Petrolube Private Limited, a company incorporated under the provisions of the Companies Act, 2013 and having its registered office in India.

For the purposes of these Terms of Use and Conditions ("Terms"), the expressions "Get Lubricants", "Company", "we", "our", and "us" shall collectively refer to NexG Petrolube Private Limited, its affiliates, subsidiaries, parent entities, directors, officers, employees, consultants, representatives, agents, licensors, technology providers, logistics partners, successors, assigns, and authorized business partners.

The platform may only be used by persons who are legally capable of entering into binding contracts under applicable laws.

By using the platform, the user represents and warrants that:

• The user is at least eighteen (18) years of age;
• The user possesses the legal capacity to enter into enforceable agreements;
• The information provided to Get Lubricants is accurate and complete;
• The user shall comply with all applicable laws and regulations.

The Company reserves the right to suspend or terminate access where eligibility requirements are not satisfied.

Certain services may require account registration.

Users are responsible for maintaining confidentiality of usernames, passwords, authentication credentials, and account information.

The Company shall not be liable for losses resulting from:

• Unauthorized account access;
• Credential sharing;
• Password compromise;
• User negligence.

Users shall immediately notify the Company upon becoming aware of unauthorized account activity.

Get Lubricants endeavors to provide accurate information relating to products, specifications, compatibility, applications, pricing, images, technical data sheets, safety data sheets, and manufacturer recommendations.

However, all information is provided on an "as available" and "as supplied" basis.

The Company does not warrant that:

• Product descriptions are error-free;
• Images exactly represent actual products;
• Specifications remain unchanged;
• Manufacturer information is complete.

Manufacturers may revise formulations, packaging, branding, specifications, approvals, certifications, and labeling without prior notice.

Users remain solely responsible for verifying product suitability before purchase or use.

Lubricants, oils, greases, coolants, additives, specialty fluids, chemicals, and maintenance products are application-specific products.

The Company does not guarantee that any product listed on the platform is suitable for a particular:

• Vehicle;
• Engine;
• Machinery;
• Industrial equipment;
• Production process;
• Commercial application.

Users must independently verify compatibility with OEM recommendations, equipment manuals, engineering requirements, and applicable operational conditions.

Any recommendations provided by Get Lubricants, technical experts, customer support personnel, AI systems, marketing materials, blogs, calculators, or automated tools are intended solely as general informational guidance.

The final responsibility for product selection remains exclusively with the user.

Despite reasonable efforts, errors relating to pricing, discounts, availability, inventory levels, technical specifications, images, descriptions, taxes, freight charges, or promotional offers may occur.

Get Lubricants reserves the absolute right to:

• Correct errors;
• Modify prices;
• Cancel orders;
• Refuse fulfillment;
• Withdraw offers.

This right shall apply regardless of whether payment has already been received.

Where payments have been received, the Company's liability shall be limited solely to refunding the amount paid.

Placement of an order constitutes an offer by the user to purchase products.

Order confirmation emails, messages, invoices, acknowledgements, or payment receipts do not constitute acceptance of the order.

The Company reserves the right to reject, modify, suspend, or cancel any order for reasons including but not limited to:

• Product unavailability;
• Pricing errors;
• Regulatory restrictions;
• Fraud concerns;
• Risk management requirements;
• Compliance issues.

Acceptance occurs only upon dispatch of products.

The Company may provide technical assistance through:

• Customer support teams;
• Product specialists;
• Technical experts;
• Lube Specialist AI;
• Blogs and educational materials;
• Product recommendation tools.

Such information is provided solely for informational purposes.

Technical information shall not constitute:

• Engineering certification;
• OEM approval;
• Warranty authorization;
• Professional engineering advice;
• Legal advice;
• Regulatory compliance confirmation.

Users must independently verify all recommendations before implementation.

To the maximum extent permitted under applicable law, NexG Petrolube Private Limited, Get Lubricants, its directors, officers, employees, affiliates, representatives, technology providers, logistics partners, suppliers, licensors, and service providers shall not be liable for any direct, indirect, incidental, consequential, punitive, exemplary, special, or economic damages.

This limitation includes damages arising from:

• Product failure;
• Equipment breakdown;
• Engine damage;
• Production loss;
• Downtime;
• Loss of revenue;
• Loss of profits;
• Loss of contracts;
• Business interruption;
• Third-party claims;
• Data loss;
• Cyber incidents.

The aggregate liability of the Company shall never exceed the amount actually paid by the user for the specific transaction giving rise to the claim.

The user agrees to defend, indemnify, and hold harmless Get Lubricants, NexG Petrolube Private Limited, its affiliates, directors, officers, employees, representatives, licensors, suppliers, technology providers, and business partners from any losses, liabilities, claims, damages, penalties, expenses, costs, and legal fees arising from:

• Violation of these Terms;
• Misuse of products;
• Regulatory violations;
• Fraudulent activity;
• False representations;
• Intellectual property infringement;
• Third-party claims.

All content appearing on the platform including:

• Logos;
• Trademarks;
• Brand names;
• Product databases;
• Technical content;
• Blogs;
• Images;
• Videos;
• Software;
• Source code;
• AI models;
• Product catalogues;

shall remain the exclusive property of the Company or its licensors. Users shall not reproduce, copy, scrape, distribute, modify, publish, reverse engineer, or exploit such content without prior written permission.

The Company shall not be liable for delays, failures, interruptions, or inability to perform obligations resulting from events beyond reasonable control including:

• Natural disasters;
• Floods;
• Earthquakes;
• Cyclones;
• Pandemics;
• Epidemics;
• Government actions;
• Regulatory restrictions;
• War;
• Terrorism;
• Civil unrest;
• Cyberattacks;
• Transportation disruptions;
• Utility failures.

The Company reserves the right to suspend, restrict, or terminate user accounts without prior notice where it reasonably believes that:

• Fraud has occurred;
• Abuse of services exists;
• Legal violations have occurred;
• Security risks exist;
• Business interests require such action.

These Terms shall be governed by and construed in accordance with the laws of India.

Any dispute, controversy, or claim arising out of or relating to these Terms shall first be attempted to be resolved through amicable negotiations.

Failing resolution, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996.

The seat and venue of arbitration shall be Kolkata, West Bengal, India.

The courts located in Kolkata, West Bengal shall have exclusive jurisdiction.

Get Lubricants reserves the right to modify, amend, replace, update, suspend, or discontinue any portion of these Terms at any time.

Continued use of the platform following publication of updated Terms constitutes acceptance of such modifications.
